Terms of Service

1. Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of ClimaInsight (the "Service"), operated by ClimaInsight ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

ClimaInsight provides climate physical risk assessments for Canadian properties, including flood, wildfire, and heat stress scoring, map visualizations, AI-generated commentary, and downloadable reports. The Service is provided for informational and screening purposes only. It is not a substitute for professional engineering, insurance, legal, financial, or environmental advice, and it should not be relied upon as the sole basis for any decision affecting property, persons, or investments.

3. Accounts

You may use limited functionality without an account. To save assessments, access Pro features, or exceed the anonymous trial, you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. One account per individual; shared accounts are not permitted. You must be at least 18 years old to register.

4. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful, internal business purposes. You will not, and will not permit any person to:

  • Scrape, bulk-extract, aggregate, resell, sublicense, or redistribute assessment data, risk scores, hazard outputs, map tiles, or any other content generated by the Service, whether manually or via automated means. Use is limited to internal evaluation of properties that you, your employer, or your clients have a legitimate business interest in.
  • Attempt to reverse-engineer, decompile, or derive the underlying models, weights, datasets, or source code of the Service.
  • Circumvent or attempt to circumvent usage limits, authentication, rate limits, or paywalls, including by creating multiple accounts to evade caps.
  • Use the Service to build a competing product or dataset, or for any unlawful, defamatory, or harmful purpose.
  • Upload data you do not have the right to share, or that contains sensitive personal information beyond what is needed for an assessment.
  • Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure.
Bulk extraction: Using the Service to compile, export, or syndicate a dataset of Canadian property risk scores — whether for resale, analytics products, or any other purpose — is expressly prohibited and will result in immediate account termination without refund.

5. Subscriptions, Billing, and Refunds

Paid tiers (including Pro at CA$149/month or CA$1,490/year) are billed in Canadian dollars via Stripe. Subscriptions renew automatically until cancelled. You may cancel at any time from the Stripe billing portal accessible from your account; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable, including for partial months and unused allotments. We may change prices on renewal with at least 30 days' notice by email.

6. Intellectual Property

The Service, including its software, models, interfaces, documentation, and branding, is owned by ClimaInsight and protected by Canadian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service and its outputs solely for your internal business purposes, subject to these Terms. You retain ownership of the inputs you provide (postal codes, addresses, metrics), and you grant us a licence to process them to deliver and improve the Service.

7. Data Accuracy and Disclaimers

Risk scores are derived from third-party datasets — including Natural Resources Canada's Flood Susceptibility Index, the NWRI Wildfire Risk Index, and CMIP6 Humidex projections — combined through ClimaInsight's scoring methodology. Climate models are inherently probabilistic, have coarse spatial resolution (typically 250m–1km), and may not reflect site-specific conditions, recent changes, or localised mitigation measures. THE SERVICE AND ITS OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CLIMAINSIGHT, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CA$100.

9. Indemnification

You agree to indemnify and hold harmless ClimaInsight from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, misuse the Service, or fail to pay fees when due. On termination, your right to use the Service ends immediately; sections that by their nature should survive (including IP, disclaimers, liability limits, and governing law) will survive.

11. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be posted on this page with an updated effective date and, for registered users, notified by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and ClimaInsight submit to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of or relating to these Terms or the Service.
